Senior BJP leader and former legislator Ravinder Raina Pathania has raised serious legal concerns regarding the implementation and interpretation of statutory provisions, particularly in light of recent reforms and judicial directions.
While addressing the issue, Pathania emphasized that when a comprehensive statutory framework already exists and the process of registration has been completed, there remains little scope for additional administrative orders. He pointed out that redundant or overlapping orders often create confusion and legal complications.
Referring to past practices, Pathania noted that multiple limitations were earlier imposed on similar matters, leading to conflicting positions—where one party was allowed to utilize or transfer rights, while another was restricted. However, with recent legal reforms incorporating and harmonizing these limitations, he argued that such restrictions should now be treated as obsolete.
Citing observations from the High Court, Pathania underlined that “dead or executed restrictions cannot be enforced as if they are still in force.” He stressed that once a legal right or property has been validly transferred, imposing fresh or unnecessary restrictions would be contrary to established legal principles.
Pathania further urged the government, particularly the Law Department, to strictly comply with judicial directives and ensure that outdated restrictions are not misapplied. He expressed hope that the administration would act in accordance with the law and uphold the rule of justice.
The issue has sparked discussion within legal and administrative circles, with calls for clearer guidelines and consistent enforcement of statutory provisions across departments.
